Job Summary

Acts as a consultant and advisor to the University Community regarding compliance with University policy and state and federal law relevant to prohibited discrimination, equal opportunity and access, disability accommodations, and affirmative action.

Responsibilities

| Serves as a resource to University administrators, patients, guests or participants, faculty, staff, and students when equal opportunity/affirmative action issues arise.

Conducts initial review of incoming discrimination complaints and disability accommodation requests for sufficiency of information.

Facilitates resolution of complaints through mediation, negotiation, etc., when determined as an appropriate resolution process. Coordinates communication between parties and the Office of General Counsel in settlement negotiations.

Independently plans and conducts investigations: Interviews complaining and responding parties and witnesses; Identifies, gathers, and reviews documentary or other evidence; Analyzes all evidence gathered during investigations, in relation to relevant University of Utah policy, state and federal laws; Concludes whether a violation of policies has occurred and prepares a written report. Coordinates with University Administration during an investigation. Serves as a support and a resource during appeals or other University hearing processes. Manages and prepares OEO /AA files for discovery or trial preparation. Evaluates visitor and other requests for accommodation and investigates alleged violations of University policy consistent with the Americans with Disabilities Act, as amended ( ADA ) or section 504 of the Rehabilitation Act (Section 504), and serves as a resource to the University regarding issues related to the ADA , accommodations, and disability access. Delivers training regarding sexual harassment, discrimination, and the ADA /Section 504 in compliance with state and federal equal opportunity and affirmative action state and federal laws. Prepares initial draft of University response to State or Federal government inquiries or complaints. Attends administrative hearings and mediation conferences with state and federal agencies. Updates OEO /AA databases and provides information and context to demographic queries.

Minimum Qualifications

Juris Doctorate Degree required. Experience in Equal Opportunity/Affirmative Action, mediation, a relevant area, or equivalency preferred. A broad and substantive understanding of investigations, legal analysis and writing, and litigation processes in the areas of equal opportunity, discrimination law, disability law, and administrative employment processes. Excellent presentation skills and demonstrated effective human relations and communication skills are also required.

Preferences

Candidates with a JD or obtaining a JD within the first six months of employment preferred. Strong legal writing skills preferred. Bilingual or multilingual preferred.
